OBLIGATIONS OF THE SENAHEBERG ASSOCIATION

The SenaHeberg association is committed to providing all the care and diligence necessary to provide a quality service in accordance with the customs of the profession and the state of the art. The SenaHeberg Association undertakes to :

1. Keep the server up and running. In case of failure of the server rented to the customer, SenaHeberg will replace it as soon as possible, unless the failure is not due to a hardware failure or other intervention that would require an interruption of service beyond the usual replacement time. In the latter case, SenaHeberg will inform the customer immediately.

2. Ensure access to the server via the Internet 24 hours a day, every day of the year. The SenaHeberg association reserves the right to interrupt the server for technical intervention to improve its operation. The same applies to any updates to the game server.

3. Intervene quickly in the event of an incident not resulting from a misuse of the server by the customer upon request for intervention by the customer.

4. Ensure that the quality of its tools is maintained at the highest level in accordance with the rules and practices of its activity.

OBLIGATIONS AND RESPONSIBILITY OF THE CUSTOMER :

The customer undertakes to provide valid contact details enabling identification: Surname, First name, organisation if applicable, Postal address, telephone number, e-mail address. SenaHeberg reserves the right to ask for proof, without any response from the customer within 72 hours, a suspension may be put in place and this may result in costs for reactivation.

The customer has the status of host within the meaning of the provisions of Article 6-I-2 of the Law for Confidence in the Digital Economy of 21 June 2004 in the sense that "it provides, even free of charge, for making available to the public by communication services to the public online, the storage of signals, writings, images, sounds or messages of any kind provided by recipients of these services". The customer undertakes to pay for any licence that may be required if he or she uses third-party software when using the Service.

The same shall apply if the customer is known to use the technique of spamming on the Internet, which behaviour shall result in the interruption of the cervice and the termination of the present contract without notice. The customer also refrains from any intrusion activity or attempted intrusion from the VPS (not exhaustive: port scanning, sniffing, spoofing ...).

The use of the services offered by SenaHeberg is under its sole control, risk and responsibility. The user is not allowed to bring to the site https://senaheberg.com and its Internet pages with content in the form of text, images or otherwise that violates the law and to engage in any activity that is illegal or that could cause harm to SenaHeberg or a third party or disrupt the proper functioning of the site. https://senaheberg.com

It is forbidden for the user to distribute the following contents, without this list being restrictive :

1. documents, information, remarks or content that are contrary to criminal law, defamatory, obscene, violent, threatening, inciting hatred, violence or discrimination or acts of a criminal nature, racist, pornographic or similar, violate the right to privacy or are likely by their nature to undermine respect for the human person and his/her dignity, equality between men and women or the protection of children and adolescents.
2. content using without authorization data belonging to third parties and protected under copyright, trademark or competition law.

It is also forbidden for the user, without this list being restrictive :

1. to transmit files containing a virus or altered data over the network.
2. to remove any copyright or proprietary designations.
3. use the site in a way that interferes with other users' access to the said site.
4. to transmit information or documents for the purpose of advertising or piracy of any kind.
5. non-rights-free music or video files encoded in MP3, DIVX or other formats.
6. dWe are not allowed to carry out actions that are simply intended to make our services unstable or for harmful purposes.
7. to operate our services through the back door for functions not intended for this purpose.
8. to use our services in order to participate in the creation of money or more commonly known as "mining", crypto-money or cryptographic money (bitcoin, litecoin, dogecoin, etc...).

It also undertakes not to include hypertext links on its site and not to redirect its domain to sites offering this type of service. In such cases, SenaHeberg reserves the right to terminate the contract immediately and ipso jure, without prejudice to the right to claim any damages that SenaHeberg may have.

RETRACTATION :

For technical and commercial reasons, we cannot reimburse you for a so-called dematerialized service. If you have the slightest problem with your virtual service, we recommend that you contact our support team as soon as possible to find a solution.
